Safetli has pleaded guilty to murdering Mr McGurk who was killed by a single shot to the head outside his Cremorne home on Sydney's lower north shore in September 2009. He has also pleaded guilty to intimidating Mr McGurk's wife Kimberley McGurk less than a year later in August 2010. The Director of Public Prosecutions has dropped a charge of soliciting Mr McGurk's murder. Mr Miralis said his client would now be giving evidence against his co-accused Ron Medich and Christopher Estephan in their committal hearing next month,

It comes more than a month after one-time featherweight boxing champion Lucky Gattellari was sentenced to a minimum of seven and a half years for being an accessory before the fact of the murder of Mr McGurk. The crown alleges Medich enlisted Gattellari to carry out the contract killing of his former business associate. Gattellari then allegedly recruited Senad Kaminic, Safetli and Estephan to help. On the day of Mr McGurk's murder it is alleged Estephan and Safetli went to his home and shot him behind the right ear at close range. Speaking outside court, Mr Miralis told reporters that as a result of ongoing negotiations between the DPP and his client, Safetli had accepted "full responsibility for his involvement in the offence".
"This has been an extremely stressful time for him, as well as his family. It's clearly the most serious charge you can plead guilty to and understandably it has had an impact on him." Safetli will be formally arraigned in the Supreme Court on Friday.
